Now that sunlight is slowly coming back into our lives, we decided to set this month's photography theme to "Spring". Head outside to take some Spring-inspired pictures of whatever you can find, and you could win an amazing ɑ5000 camera!

 

Remember, you’re only one shot away from winning our monthly photography competition! All you have to do is upload your photographs to the Competition gallery here, and tag them with your country label. Good luck!

 

Terms and Conditions

 

1.  This promotion is open to residents of the UK, France, Germany, Austria, Portugal, Switzerland, Ireland, Nordics, Poland, Belgium, Netherlands, Spain, Russia and Romania only and entrants must be aged 18 or over.

2. Entrants will need to select the correct label for their country of residence. Entrants who select the wrong country will not be eligible to win.

3. No purchase is necessary to participate in the competition.

4. In order to be eligible to enter the competition you must have a Community profile.  If you do not have one, you can register on the site for free (at http://community.sony.co.uk).

5. Members of Sony and their supporting agencies are not allowed to join the competition.

6. Please be aware that taking pictures of random people on the street is prohibited by law without their consent. Please always make sure to ask their approval upfront.

7. The winner will receive an ɑ5000 camera.

8. The competition runs from 12:00 (noon) CET on Monday 10th of March 2014 and will close on Sunday 6th of April at 23:59 CET. No entries will be accepted after 23:59 CET on that date. 

9. All submissions must be the user's own work. Please make sure that you’re the image owner and have full rights on the picture. If you take pictures of people please make sure that you have a signed model contract.

10. Pictures will be judged by our photo community team. The winning picture selection will take place on Tuesday 8th of April 2014.  The judge’s decision is final. (Votes are only a reference and are not the deciding factor.)

11. The winner will be notified by email within 2 days of the selection having taken place.

12. If no response to the notification is received from the winner within 72 hours, the Promoter reserves the right to award the prize to an alternative winner.

13. The prize will be delivered to the winner within 6 weeks after the date of response from the winner.

14. Any taxes payable in relation to the prize will be for the winner to bear.

15. No maximum number of competition entries.

16. The prize is not transferable or exchangeable. No cash or credit alternative is available.

17. Should the prize become unavailable for any reason, the Promoter reserves the right to provide a substitute, similar prize of approximately equivalent or greater value.

18. By entering the prize draw, participants will be deemed to have accepted and agree to be bound by these terms and conditions.

Please can someone provide me with the piece of legislation which warrants paragraph 6 of the terms and conditions for the Spring photograph competition. I am very serious about this question because I am currently towards the end of a college course and have done some research. My understanding is that in England there is NO legislation which prevents a person taking a picture of another when in a public place. I accept it may be good manners, but it is NOT against the law. Please clarify Sony.

Without doing huge research on this subject (ill let you do that) - I would first look at EU legislation, such as

  • Article 8 of the Human Rights Act 1998 (Right to Privacy).
  • Acticle 10 of the Human Rights Act 1998 (Freedom of Expression)

However, I think there is also a case of proportionality with these things.  Such things as stalking people (ie photos of females at the beach without their consent etc etc).  However if its a picture of a huge group such as at a consert or football stadium - obviosly one cannot get everyones consent. 

 

Its a start anyhow.

You may well be correct but you have to consider (Point 1) that this competition is open to more countries in Europe than just England so the terms and conditions would have to cover all Countries.

The UK Home Office says:

 

"There is no legal restriction on photography in public places, and there is no presumption of privacy for individuals in a public place.

 

It is for the Chief Constable to ensure that Officers and Police Community Support Officers are acting appropriately with regards to photography in public places, and any queries regarding this should be addressed to the Chief Constable. However decisions may be made locally to restrict photography, for example to protect children. Any questions on such local decisions should also be addressed to the force concerned."

 

Professional photography is banned in Trafalgar Square, Parliament Square, and Royal Parks.

Thank you for all for the replies to date. Thankfully my research was right, perhaps paragraph 6 in the terms and conditions should be amended to reflect that restrictions MAY be present. I was concerned that I had missed something in my college work!
